SteadyPace is a product of Zero To Build LLC. All references to "we," "us," "our," or "SteadyPace" in these terms refer exclusively to Zero To Build LLC and its products — not to any individual person, officer, member, or employee.
By downloading, installing, or using SteadyPace ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App. Your use of the App constitutes acceptance of these terms in their entirety.
SteadyPace is NOT a medical device, medical application, therapeutic intervention, or substitute for professional medical, psychological, or psychiatric treatment. The App does not provide medical advice, diagnosis, or treatment of any kind. Nothing in the App, on our website, or in any communication from Zero To Build LLC should be interpreted as medical advice.
The App does not diagnose, treat, cure, mitigate, or prevent any disease, disorder, condition, or illness — including but not limited to anxiety disorders, panic disorder, agoraphobia, post-traumatic stress disorder, cardiovascular conditions, or any other medical or psychological condition.
SteadyPace is a general wellness and self-improvement tool that provides structured exercise suggestions. The graded exposure approach used in the App is inspired by widely known behavioral principles but is not a clinical implementation of any therapeutic protocol. Use of the App does not create a patient-provider, therapist-client, or any other clinical relationship.
Exercise carries inherent risks including but not limited to injury, illness, and death. You assume all risk associated with your use of this App and any exercise you perform.
Before using SteadyPace, you should consult with a qualified healthcare provider, particularly if you:
Stop exercising immediately and seek medical attention if you experience chest pain, severe dizziness, difficulty breathing beyond normal exertion, heart palpitations, fainting, nausea, or any symptoms that concern you. The App's "I feel it starting" feature is a self-regulation tool — it is NOT medical guidance and does NOT replace emergency medical care.
Exercise plans in the App are generated by artificial intelligence. AI-generated content may contain errors, inaccuracies, or suggestions that are not appropriate for your individual circumstances. Zero To Build LLC does not guarantee the accuracy, safety, or appropriateness of any AI-generated exercise plan. You are solely responsible for evaluating whether any suggested exercise is safe and appropriate for you.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Zero To Build LLC makes no representations or warranties regarding the accuracy, reliability, completeness, or timeliness of any content, information, or recommendations provided through the App.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZERO TO BUILD LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to damages for personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of data, or any other damages arising out of or related to your use of or inability to use the App, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if Zero To Build LLC has been advised of the possibility of such damages.
IN NO EVENT SHALL ZERO TO BUILD LLC'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ZERO TO BUILD LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the liability of Zero To Build LLC shall be limited to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless Zero To Build LLC, its members, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) any exercise or physical activity you perform in connection with the App; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
You are responsible for maintaining the security of your account. You must be at least 13 years old to use SteadyPace. By creating an account, you confirm you meet this age requirement.
SteadyPace offers auto-renewable subscriptions managed through Apple's App Store:
Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings. No refunds are provided for partial subscription periods.
New users receive 3 free sessions. Free sessions do not expire but cannot be restored once used.
All content, designs, code, trademarks, and the Pace character are the exclusive property of Zero To Build LLC. You may not copy, modify, distribute, sell, or create derivative works from any part of the App without prior written permission.
We reserve the right to suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the App's settings.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Zero To Build LLC regarding your use of the App and supersede all prior agreements.
These Terms are governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Oregon.
Zero To Build LLC reserves the right to modify these Terms at any time. Updated terms will be posted in the App and on our website. Your continued use of the App after any modification constitutes acceptance of the updated Terms.
